With two days of Supreme Court hearings this week on several pieces of gay marriage legislation, debate on the issue is in the public spotlight. Some of those resisting the country's shifting public-opinion on accepting same-sex marriage argue that the institution of marriage is changed by including gay couples. "By definition — solely, by definition — same-sex people cannot be married," conservative radio host Rush Limbaugh said on his show on Thursday, according to ABC news. Ruling strikes down other portions of Obamacare.
ABC News is reporting that the Supreme Court, in a split decision, has upheld the individual mandate that requires the purchase of insurance as a tax. The Supreme Court has ruled in a 5-4 decision to uphold the Affordable Care Act, declaring its individual mandate to be constitutional. The argument against the constitutionality of the individual mandate had been that it violated states' rights, but proponents cited the Constitution's commerce clause as justification. However the court seems to have found a way around the argument, ruling that the mandate was constitutional anyway under Congress' ability to tax. Legal cases against the Affordable Care Act will go to the Supreme Court on Monday.
Monday's Supreme Court hearings on the Affordable Care Act will pit the Obama administration against 26 states and several private parties hoping to challenge the congressional power asserted in the legislation critics derisively call "Obamacare." Much of the planned six hours of oral arguments will aim at the act's "individual mandate," which requires each U.S. citizent to purchace healthcare, the Huffington Post reports. "The Obama administration says the mandate falls squarely within Congress's ability to regulate national markets. OK, you don't like the use of the term marriage. But you don't OWN the term, either. Thank you for not responding again. I get tired of defending my right to enjoy the same basic opportunities as the majority, though I don't hurt anybody by doing so.
